The Title Examiner is responsible for reviewing property records, legal documents, and public records to verify the ownership history of real estate properties. This includes ensuring that titles are free of defects, identifying any encumbrances or liens, and resolving issues that may affect the transfer of title. The role requires attention to detail, strong analytical skills, and knowledge of real estate law and procedures.

Key Responsibilities:

  • Title Search and Examination :
  • Conduct thorough searches of public records (such as deeds, mortgages, liens, judgments, and tax records) to verify ownership and identify any potential issues related to the property title.
  • Analyze legal documents, including deeds, wills, trusts, and other conveyance documents, to establish the chain of title.
  • Ensure the title is clear, free of encumbrances, and legally transferrable.
  • Liens and Encumbrance Identification :
  • Identify any outstanding liens, judgments, mortgages, or claims on the property that could affect its transfer or financing.
  • Report findings to appropriate parties, such as title companies, lenders, and real estate agents.
  • Assist in resolving title defects, such as unpaid taxes or unresolved legal issues.
  • Preparation of Title Reports :
  • Prepare and present detailed title examination reports that summarize findings, including any defects, encumbrances, or discrepancies in the title.
  • Provide recommendations for clearing any title issues, such as obtaining release documents or filing corrective legal actions.
  • Collaboration with Legal Teams :
  • Work closely with legal professionals, including attorneys and paralegals, to resolve complex title issues or disputes.
  • Assist in drafting title commitments, policies, and other related documents.
  • Risk Management :
  • Assess and mitigate risks associated with property transactions by ensuring that the title is marketable and insurable.
  • Collaborate with insurance agents or title underwriters to ensure that title insurance policies can be issued based on the examination.
  • Stay Current with Laws and Regulations :
  • Keep up-to-date with changes in real estate laws, title-related regulations, and industry practices.
  • Attend training sessions and workshops as necessary to stay informed on new procedures and best practices in title examination.
  • Customer Service :
  • Communicate with clients, including buyers, sellers, lenders, and real estate agents, to provide status updates and clarify any concerns related to title examination.
  • Answer questions and offer advice on how to resolve title issues.
Qualifications:

  • Education :
  • A high school diploma or equivalent is required.
  • A degree in real estate, paralegal studies, or a related field is preferred.
  • Experience :
  • Previous experience in title examination, real estate, or a related field is highly preferred.
  • Knowledge of title software and property record systems.
  • Skills :
  • Strong attention to detail and accuracy.
  • Proficient in reading and interpreting legal documents, deeds, and contracts.
  • Knowledge of real estate laws, title insurance, and the title examination process.
  • Excellent research, organizational, and analytical skills.
  • Ability to work independently and manage multiple projects simultaneously.
  • Strong communication skills, both written and verbal.
